Esta semana que pasó, la Suprema Corte tuvo la oportunidad de demostrar que la justicia es “para todos”, al sentenciar en la causa “Larrabure”; oportunidad que, por supuesto, la dejó pasar y mediante un argumento pueril cerró definitivamente la cuestión.
Los máximos togados del país aprovecharon la noticia de la muerte del principal imputado, el terrorista del ERP (Ejército Revolucionario del Pueblo) Kremer, para declarar “abstracto” el planteo, a pesar de que en la causa se había informado que existían otros terroristas, para imputar. Esto no les importó y sin sonrojarse le pusieron “punto final” al debate, DEJANDO EN CLARO QUE LOS DELITOS DE LOS TERRORISTAS ESTAN PRESCRITOS MIENTRAS QUE LOS DE LOS MILITARES Y POLICIAS NO, SON IMPRESCRIPTIBLES.
Una verdadera canallada de la Justicia, si tenemos en cuenta en que los expedientes “de lesa”, los jueces y fiscales no se cansan de decir que, a pesar de que los imputados estén muertos (militares y policías), las victimas tiene el derecho a conocer la verdad, de cómo sucedieron los mismos y quienes son los responsables.
Un ejemplo de esto, fue la payasada del juicio conocido como “la masacre de Napalpí”, donde la Justicia Federal de Resistencia realizó audiencias entre los meses de abril y mayo del año 2022, sobre un hecho ocurrido en el año 1924. En ese proceso no hubo imputados (estaban todos muertos, obvio), declararon los nietos y bisnietos de las víctimas junto a ideologizados historiadores, considerándose en consecuencia probados los hechos y declarándoselos como crímenes de lesa humanidad. ¡Hasta hubo sentencia y todo!
En base a ello, en un juicio “de lesa” que se está llevando adelante en la ciudad de Rosario, donde la Fiscalía pretende que el Tribunal “emita un pronunciamiento declarativo de la intervención que a cada uno le cupo en los hechos delictivos aquí endilgados” de imputados fallecidos o apartados del proceso por incapacidad, con el argumento de que “Lo que aquí pretendemos excede la idea de sanción penal y llega hasta abarcar la reparación integral respecto de las personas que fueron afectadas por estos delitos que ofenden a toda la sociedad, tarea en la cual la reconstrucción de la verdad tiene una preeminencia innegable”.
AHORA, SE VE QUE PARA LA JUSTICIA LAS VICTIMAS DEL TERRORISMO NO TIENEN DERECHO A CONOCER LA VERDAD NI QUE SE TRAMITE UN JUICIO PARA CONOCERLA. SE VE QUE LOS DELITOS DEL TERRORISMO NO OFENDE A LA SOCIEDAD.
De anverso, no puede dejarse de considerar que los jueces “otean”, como se dice vulgarmente, el panorama político. Así ven que el Presidente se ha cansado de decir que el tema de los juicios “de lesa” no está en su agenda y que constantemente denota y defenestra a su propia Vicepresidente, a la cual hasta llegó a llamar “bruta traidora”, la cual justamente es la abanderada de los derechos de las víctimas del terrorismo. TODA UNA DEFINICION POLITICA QUE CLARAMENTE LOS JUECES OBSERVAN.
Esta felonía libertaria ha llevado a la Justicia a traspasar todos los límites de la ilegalidad, transformándose algunos jueces, en especial los de Casación, en obscenos prevaricadores. Un ejemplo de ello es la férrea negativa a otorgar libertades condicionales a los militares y policías que han cumplido en exceso los requisitos para que proceda tal instituto procesal. Resulta que han transformado el concepto de “reinserción social”, que sencillamente implica que la persona condenada en un proceso penal haya comprendido el alcance de la condena recibida para no volver a delinquir cuando recupere la libertad, en un incondicional reconocimiento de los hechos que cometió, un absoluto pedido de perdón y encima que digan donde están los desaparecidos.
Tal ridícula exigencia violenta gravemente la regla consignada en el artículo 18 de nuestra Constitución Nacional que prohíbe la autoincriminación, así como también lo dispuesto en el artículo 14 apartado ‘g’ del Pacto Internacional de Derechos Civiles y Políticos que determina que nadie “será obligado a declarar contra sí mismo”. Amén de obligarlos a dar una información, que quienes aún quedan vivos no solo desconocen por la baja jerarquía que tenían en aquellos años, sino también porque nadie sabe a ciencia cierta la verdad sobre esa “supuesta” información.
No olvidemos, que fue el propio gobierno el que anunció con “bombos y platillos” una auditoria sobre el cobro de indemnizaciones de presuntos desparecidos o detenidos, que habrían fraguado esa condición, auditoria de la cual NUNCA SE SUPO MÁS NADA. Sin dejar de mencionar que el propio Presidente de la Nación, cuando era candidato, no vaciló en afirmar que la cifra de 30.000 era mentira y hasta en una conferencia de prensa en Tucumán, cuando se le preguntó al respecto, le contestó a la periodista que le muestre la lista completa de los 30.000 desaparecidos.
Este absurdo, el cual permite este gobierno, no contempla que, hoy, NO existe la más minina posibilidad -ni remotamente- que en nuestro país se vuelva a producir hechos como los ocurridos en los años 70. Ni que alguien imagine tan siquiera tal probabilidad. Fue una verdadera tragedia que nadie quiere repetir.
Claramente los militares y policías condenados en estas causas denominadas “de lesa” ya han purgado su condena y solo pretenden vivir sus últimos años en paz, lejos de todo lo que represente aquellos penosos hechos y oscuros años. Muchos ya han sobrepasado, en exceso, los años por lo que fueron condenados.
Ya no hay dudas que el tan vociferado cambio cultural que pregonan los libertarios es solo “jarabe de pico”, poniéndose el gobierno en la lacerante actitud hacia la sociedad, de solo reclamar por los actos terroristas perpetrados por el terrorismo islámico, omitiendo deliberadamente los actos terroristas cometidos por el terrorismo “autóctono”. Tan solo, en solitario la Vicepresidente de la Nación los recuerda de tanto en tanto, como hará esta semana con los héroes del heroico combate de Manchalá ocurrido el 28/5/75 en un paraje rural de Tucumán.
Al “León” no le interesa ni la pacificación del país ni la reconstrucción de la Nación, solo mira sus propios y espurios intereses. Más aún, toda idea o proyecto que delirantemente asocie o su lo haga su hermana a la Vicepresidenta, lo eliminarán automáticamente de la gestión.
Como digo el arzobispo de Buenos Aires, cardenal Mario Poli: “Convencidos de la verdad de las enseñanzas de Cristo desde la Cruz, seguimos pensando que la reconciliación es el camino de la paz, la justicia y un futuro prometedor para todos, sin exclusión.
