¿Qué pasaría si el presidente fuera arrestado?

Suponiendo que el Fiscal General y el Departamento de Justicia decidieran que tienen pruebas suficientes para presentar cargos contra un presidente en funciones de los Estados Unidos, entonces estaríamos en una crisis constitucional. Si los cargos fueran tan graves, podría ser necesario invocar la Enmienda 25 y que el presidente fuera destituido de su cargo por ley. Eso llevaría días, y quienquiera que fuera el presidente casi con toda seguridad se encontraría esencialmente bajo “arresto domiciliario” mientras se resolvía el asunto para evitar la posibilidad de una fuga ilegal para evitar el procesamiento.

No habría tal confrontación con el Servicio Secreto, ya que son miembros jurados de las fuerzas del orden. Se arriesgarían a perder sus funciones de aplicación de la ley (y potencialmente a ser arrestados ellos mismos) si intentaran interferir con una orden de arresto que el FBI ejecutara legalmente. Si algunos de ellos decidieran (por cualquier razón) no hacerlo, serían arrestados por sus colegas o se unirían al presidente en su viaje por la calle hasta el edificio del FBI J. Edgar Hoover esposados ​​cuando fueran arrestados por el FBI.

Lo que ocurriría es que al presidente se le permitiría dimitir discretamente, abandonaría la Casa Blanca y, en unos días, se le permitiría entregarse discretamente en un tribunal federal relativamente cerca de su casa. Habría una seguridad extremadamente estricta, se haría pública una declaración básica a los medios de comunicación y no se aceptarían preguntas en ninguna conferencia de prensa que se celebrara. Dado que incluso el peor presidente querría evitar una confrontación armada y que nadie quiere la humillante escena de un presidente actual o anterior de los Estados Unidos siendo sacado de la Casa Blanca esposado, las cosas serían mucho más tranquilas.

    With Trump facing possible jail in this case and others, make no mistake he is the most dangerous he has ever been. Evidence in all cases and his refusal to take responsibility has shown there is no end to the lengths he will go to get what he wants.

    The impeachment proceeding is conducted by the Senate, and if the Senate decides the president didn’t do anything wrong the president can be returned to office. While the president is facing impeachment the vice president becomes the acting president, and the president temporarily has no political power until s/he is cleared by the Senate. If, on the other hand, the Senate finds the president guilty, the president may be removed from office and face a judge

    after impeachment the President would then be tried, and, if so, convicted by the Senate. If convicted the President would thence be removed from office. However, one can speculate that the Vice President, who would then become the President, would pardon the former President.

    What I don’t like is that there are some wealthy people or people in power that are able to get away with almost anything. Such as sexual assault, murder, drunk driving etc. It’s not fair. Just because they have the world of lawyers doesn’t mean that they are the boss. I hope the President is able to go to jail if they do anything wrong.
