A fines de noviembre del año 2014 por obra, gracia, e inferencias de un delincuente secretario de la justicia federal de Bahía Blanca, que oficiaba de juez subrogante y hoy es fiscal, llamado ULPIANO MARTINEZ, terminé en la cárcel, imputado por los bien o mal llamados delitos de lesa humanidad. Así fui alojado en la Unidad Penitenciaria 31 y más precisamente en el pabellón 19, conocido como “Barrio Chino” (hoy no existe, en su lugar se construyeron oficinas). En sí era un galpón de 22 (72 pies) por 12 (39 pies) por 8 metros (26 pies), con pretensión de salón, en el que había unas 20 o más camas, acorde al ingreso de cautivos, las duchas, letrinas y cocina comedor, todo en un solo ambiente en el que faltaba ventilación y privacidad y sobraban cucarachas. En un rincón al final de todo y a dos camas de por medio de la mía, se encontraba alojado un señor, llamado JUAN POMARES con quien solía intercambiar libros y películas. De conducta correcta, callado y profunda fe cristiana, estaba con prisión preventiva desde el año 2011, siempre predispuesto a ayudar a los prisioneros que se descompensaban.
Luego de irme de ese lugar indigno, en marzo del año 2016, él fue a juicio en el 2017 y a fines de noviembre de ese año el Tribunal Oral Federal 1 de La Plata lo absolvió, en medio de la protesta de representantes de organizaciones radicalizadas de derechos humanos para quienes los miembros del poder judicial tienen que ser esbirros a su servicio.
Lo destacable que muchos togados por ideología o cobardía lo son. Tras remover cielo y tierra en abril del año 2018 la Cámara de Casación Penal 4 por sentencia de los jueces GUSTAVO HORNOS, MARIANO BORINSKY y JUAN CARBAJO, anuló la absolución de POMARES diciendo que: “no hace falta la realización de un nuevo juicio,puesto que el mismo resultó válido en todos sus términos, sino solamente el dictado de una nueva sentencia al respecto de los hechos que los acusadores le endilgan”. Días pasados y para ser más precisos el 9 del corriente, el Tribunal Oral porsegunda vez lo volvió a absolver a POMARES. Hace pocas horas, los fiscales generales HERNÁN SCHAPIRO y GONZALO MIRANDA, y el auxiliar fiscal JUAN MARTÍN NOGUEIRA, recurrieron la medida y solicitaron la anulación de la sentencia y el dictado de un fallo condenatorio para el acusado. De lograrse esto, se habrá impuesto una vez más la “política de estado”, equivalente a “para el enemigo ni justicia” cumpliéndose lo de: “A DONDE VAYAN LOS IREMOS A BUSCAR”. Remanida frase utilizada por los indemnizados asesinos terroristas del pasado, devenidos en “jóvenes idealistas del presente y sus seguidores.
