No estoy poniendo en dudas maniobras políticas, el ministerio deberá explicar su participación o no en hechos ilegales. La investigación judicial deberá (debería) establecer la génesis y el desarrollo de esta irregularidad. La incógnita es en quién confiar si existen jueces militantes en algunos casos y no en otros.
Cuando se trata de restablecer el Estado de derecho, la teoría política recurre a la malicia de la oposición. Cuando esta aplicación es sometida en los casos de Lesa Humanidad, desaparecen las teorías de conspiraciones y los jueces son justos. Este enfoque sigue siendo cuestionado por abogados que están convencidos –siguiendo la tradición de la ley– de que invocar esta fórmula es inaceptable porque viola un requisito fundamental del Estado de derecho, el de legalidad.
Independientemente del valor de esta preocupación, la ley no es aplicable pese a que los Derechos Humanos son universales, ya que la ley resultante de las trampas y abusos en tribunales argentinos pareciera ser algo aceptado. Testimonios falaces que no son castigados, víctimas inventadas continúan teniendo pol militares, policías o agentes del estado tras las rejas. Estas imperfecciones jurídicas no utilizan lógicas matemáticas, y el estado de derecho militante necesita la inclusión sistémica de estas deficiencias para incrementar esos abusos. La evidencia es fundamental es que cuando se comprueba la mentira de un testigo, los jueces no interfieren, ni ningún fiscal actúa de oficio.
Pero, la distinción entre los gobernantes y la ciudadanía es otra gran grieta que nadie ve, por fanatismo, por desesperación o por militancia. Y esa grieta es creada por un gobierno que dice combatir a la casta y -supuestamente- anhela cerrar grietas.

Los mismos Jueces que trabaron los juicios contra Menem, cuando cayó, sacaron las causas que tenían debajo de varias, las pusieron arriba y los mandaron encana. Que después se haya amparado en fueros inexistentes, es otro cantar, pero le bajaron DOS (2) CONDENAS FIRMES. Así que no tengo dudas que puede volver a pasar.
