La cultura de la corrupción en Argentina hace parte de su historia política-social, constituye el ADN en la sociedad y de las instituciones públicas, ella está generalizada, nadie puede ignorar los “arreglos” en todas las esferas del Estado y particularmente en los estrados judiciales; siempre es bueno tener un juez amigo. Desde hace décadas, jamás un alto funcionario o miembro del poder judicial, legislativo o ejecutivo hizo públicamente conocer esos delitos, con nombres, apellidos, hechos.
Recientemente ese pacto del silencio se rompió porque el Ministro de Justicia de la Nación denunció la comisión de grave delitos en los casos de las indemnizaciones a supuestas víctimas del gobierno militar 76-83.
Cuneo Libarona
El 23abril2024, en la entrevista con el diario La Nación, el Ministro de Justicia, precisó entre otros puntos que: “… se procesó a un conjunto de personas por los delitos de asociación ilícita, falsificación de documentos públicos y privados, uso de documentos públicos, falso testimonio, falsa denuncia, estafa y defraudación en perjuicio de la Administración Pública Nacional. A su vez, existen otras causas penales en trámite por irregularidades surgidas por pagos duplicados o realizados a personas que carecen de documentación que respalde su pedido”. Asimismo, el Ministro Cuneo Libarona afirmó que “no podrían haber ocurrido sin una ayuda política”. “No se pueden haber dado estos hechos si no existiera alguna actuación de un funcionario público. Era un festival de pagos, de crear estructuras para generar plata del Estado”,
En la TV, TN, el 29abril2024; el ministro de justicia «Cúneo Libarona informó que la auditoría surge de la causa “Martínez Moreira, Adrián y otros s/ defraudación, falsificación de documentos públicos y asociación ilícita”, en la que se procesó a un grupo de personas por estafa al Estado. También existen “otras causas penales en trámite” por irregularidades vinculadas a pagos duplicados o realizados a personas que no contaban con documentación respaldatoria. Incluso familiares de personas que estaban viviendo en el exterior y no desaparecidas»
Los hechos denunciados se conocen como “Fraudes Millonarios con los Derechos Humanos”[2] y la gravedad de esos ilícitos es qué se utilizó a las ONG con la bandera de los llamados derechos humanos, para que, con la complicidad de abogados, altos funcionarios del Estado, miembros de la justicia (jueces, fiscales, secretarios), militantes de DDHH y reales delincuentes, recurriendo a medios ilícitos, tanto en Argentina como en el exterior puedan obtener ilegalmente indemnizaciones faraónicas, como supuestas víctimas del gobierno militar 76-83. Así estafar al Estado argentino y hacer condenar a numerosos inocentes.
Es decir que, se creó una organización criminal internacional para cometer delitos en más de un país, actuando a nivel transnacional con roles y objetivos precisos. Los miembros de esa empresa del delito diseñaron y ejecutaron un plan macabro, formando personas, para inventar hechos, falsificar documentos, crear ex-nihilo una historia, construir pruebas falsas, designar un culpable entre los ex agentes del Estado de los 70’ y hacerlo condenar por crímenes aberrantes, con el objetivo de recibir beneficios millonarios por parte del Estado. ¿Entre cuantos se repartían ese botín? Ese accionar no solo es un delito que tiene sus ramificaciones fuera de las fronteras nacionales, sino también una estafa a la Nación y a sus contribuyentes que aportan a los recursos del Estado para pagar esas indemnizaciones. «La Justicia investiga la existencia de una supuesta asociación ilícita para el armado de documentación falsa para aquellos que simulaban ser hijos de desaparecidos o víctimas de la última dictadura militar» (TN 29abril24).
Las supuestas víctimas y los testigos falsos fueron preparados en centros especializados, escuelas de testigos, para formar declarantes profesionales, simuladores, mentirosos, adiestrados a decir, a mencionar, a describir historias inexistentes. Los responsables de esos centros y/o escuelas de preparación a los falsos testimonios deben ser investigados, juzgados y condenados.
La justicia honesta con la cooperación internacional debe, inmediatamente, identificar en Argentina y en el extranjero, no solo los que percibieron ilegalmente las indemnizaciones del Estado porque en absoluto fueron víctimas de la violencia por parte del gobierno militar en ese periodo, sino y, sobre todo, porque “sus declaraciones o sus casos”, que sirven de pruebas en los juicios llamados de lesa humanidad, determinaron que numerosas personas fueran imputadas y condenadas a largos años de prisión, cuando en realidad no cometieron delito alguno.
Ese contexto se pudo materializar porque previamente los miembros designados de la organización criminal, tanto en Argentina como en el extranjero (Europa, América Latina), creaban falsos documentos, falsas denuncias, falsas pruebas, falsos testigos, falsas víctimas, con el objetivo de culpar una persona de un hecho inexistente, se lo llevaba a juicio y se lo condenaba por lesa humanidad pese a ser inocente. Ese dispositivo es un proyecto criminal protegido por un círculo perfecto de impunidad, integrado por la justicia en todos sus niveles, abogados querellantes, organizaciones de DDHH, altos funcionarios del Estado, responsables políticos de la Secretaria de Derechos Humanos de la Nación, los que actuaban desde el extranjero y el silencio cómplice de los medios de comunicación. Los procesos judiciales en los cuales estos delincuentes obtuvieron resoluciones favorables no pudieron realizarse sin la complicidad de los magistrados, secretarios, fiscales, secretaria de derechos humanos, asociaciones de derechos humanos, militantes de DDHH, consejeros y asesores nacionales o internacionales.
Por cada persona que cobró una indemnización como integrante de una organización criminal, supone una acción transversal y una incidencia directa en los juicios de lesa humanidad con consecuencias inimaginables, inconmensurable sobre las personas condenadas por delitos inexistentes. Ese impacto no es solamente en la libertad personal, sino en la salud, en la sanción social, la repercusión mediática, el impacto negativo a nivel nacional e internacional, todo ello extensiva a su familia, cuando en realidad nunca existió víctima, ni hecho doloso, ni culpable, todo se limita a beneficios materiales estafando al estado.
Los métodos, las formas y los actores que llevaron y llevan a cabo los delitos denunciados por las autoridades nacionales encuadran perfectamente en la Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional[3], la que precisa, por ejemplo:
2: a) Por “grupo delictivo organizado” se entenderá un grupo estructurado de tres o más personas que exista durante cierto tiempo y que actúe concertadamente con el propósito de cometer uno o más delitos graves o delitos tipificados con arreglo a la presente Convención con miras a obtener, directa o indirectamente, un beneficio económico u otro beneficio de orden material; b) Por “delito grave” se entenderá la conducta que constituya un delito punible con una privación de libertad máxima de al menos cuatro años o con una pena más grave; c) Por “grupo estructurado” se entenderá un grupo no formado fortuitamente para la comisión inmediata de un delito y en el que no necesariamente se haya asignado a sus miembros funciones formalmente definidas ni haya continuidad en la condición de miembro o exista una estructura desarrollada;
3.2.: A los efectos del párrafo 1 del presente artículo, el delito será de carácter transnacional si: a) Se comete en más de un Estado; b) Se comete dentro de un solo Estado, pero una parte sustancial de su preparación, planificación, dirección o control se realiza en otro Estado; c) Se comete dentro de un solo Estado, pero entraña la participación de un grupo delictivo organizado que realiza actividades delictivas en más de un Estado; o d) Se comete en un solo Estado, pero tiene efectos sustanciales en otro Estado.
Artículo 5. Penalización de la participación en un grupo delictivo organizado. 1. Cada Estado Parte adoptará las medidas legislativas y de otra índole que sean necesarias para tipificar como delito, cuando se cometan intencionalmente:
a) Una de las conductas siguientes, o ambas, como delitos distintos de los que entrañen el intento o la consumación de la actividad delictiva:
i) El acuerdo con una o más personas de cometer un delito grave con un propósito que guarde relación directa o indirecta con la obtención de un beneficio económico u otro beneficio de orden material y, cuando así lo prescriba el derecho interno, que entrañe un acto perpetrado por uno de los participantes para llevar adelante ese acuerdo o que entrañe la participación de un grupo delictivo organizado;
ii) La conducta de toda persona que, a sabiendas de la finalidad y actividad delictiva general de un grupo delictivo organizado o de su intención de cometer los delitos en cuestión, participe activamente en: a. Actividades ilícitas del grupo delictivo organizado; b. Otras actividades del grupo delictivo organizado, a sabiendas de que su participación contribuirá al logro de la finalidad delictiva antes descrita;
b) La organización, dirección, ayuda, incitación, facilitación o asesoramiento en aras de la comisión de un delito grave que entrañe la participación de un grupo delictivo organizado.
El conocimiento, la intención, la finalidad, el propósito o el acuerdo a que se refiere el párrafo 1 del presente artículo podrán inferirse de circunstancias fácticas objetivas.

Es decir que, esas características por las formas de cometerse el delito de estafa al Estado argentino con los derechos humanos, están comprendidos en la Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional, porque fueron cometidos por un grupo delictivo organizado y estructurado (art.2.a, c), son infracciones graves (art.2.b), esos hechos criminales ocurrieron en más de un país (art.3.2.a, b, c, d), hubo participación a un grupo criminal organizado (art.5), se produjo el blanqueo producto del delito (art.6), para ejecutar esos delitos se cometieron actos de corrupción pasiva y activa (art.8) y sobretodo existió una obstrucción al buen funcionamiento de la justicia (art. 23). Ese descriptivo propio de una empresa del crimen organizada va más allá de la simple asociación ilícita (art 210 CP), o el atentar contra el orden económico de la Nación, (303 CP).
De manera urgente el Gobierno del Presidente Milei, en nombre del Estado de Derecho, de los principios de legalidad, del Orden Jurídico nacional e internacional, de los principios convencionales, constitucionales y de los derechos humanos para todos los individuos que residan en el territorio argentino, debe ordenar:
Al Procurador General de la Nación u otra instancia que considere pertinente, que todos los juicios en curso de lesa humanidad y las personas privadas de libertad (en prisión o domicilio) acusadas o condenadas por haber cometido esos supuestos delitos, deben ser puestos en inmediata libertad porque los juicios por los cuales se los acusó y condenó son nulos, de nulidad absoluta dado que los jueces y fiscales, no eran ni son objetivos, independientes e imparciales, las víctimas y los testigos eran y son falsos y mentirosos, las pruebas y los delitos imputados eran y son inexistentes, los abogados defensores de esas supuestas víctimas eran y son en realidad cómplices. Todos ellos eran y son integrantes de un grupo criminal organizado.
Al Procurador General de la Nación u otra instancia que considere pertinente, procede inmediatamente a investigar y llevar a juicio a los miembros de la estructura criminal organizada (personal del poder judicial, alto funcionarios del Estado, abogados querellantes, militantes de los DDHH, representantes de ONG de DDHH…), autores de los delitos denunciados por el Ministro de Justicia de la Nación.
La intervención del Consejo de la Magistratura en cuanto al rol que ocuparon los miembros del Poder Judicial en los casos de la estafa al Estado argentino con los derechos humanos y sus consecuencias en los juicios llamados de lesa humanidad.
A la Cancillería Argentina que requiera la cooperación internacional con el objetivo de investigar en los países donde se iniciaron o transitaron los trámites, los actores participantes, la legalidad de las diligencias y pruebas para obtener las indemnizaciones por las supuestas víctimas de DDHH en el gobierno militar 76-83
La inmediata suspensión en sus funciones de los miembros del Poder Judicial y de la Administración Pública en general que intervinieron en los casos relacionados con la estafa al Estado con los derechos humanos. Esos funcionarios no pueden continuar en sus funciones en nombre de la lucha contra la corrupción, la transparencia y principios deontológicos.
La sociedad, el contribuyente, el ciudadano honesto, los hombres y mujeres de buena voluntad, necesitan conocer los nombres de los responsables del fraude a la Nación con los Derechos Humanos, que los mismos sean juzgados y condenados. Buenos Aires

La Delegación a Asociaciones Israelitas Argentinas (DAIA) y Abuelas de Plaza de Mayo dieron a conocer este martes su posición respecto de la candidatura de Ariel Lijo para integrar la Corte Suprema de Justicia de la Nación.
Lo hicieron a través de dos cartas, dirigidas al ministro de Justicia de la Nación, Mariano Cúneo Libarona, en la que manifestaron las razones del acompañamiento a la postulación que realizó el presidente Javier Milei.
En el caso de DAIA, su titular, Jorge Knoblovits, indicó que el candidato en cuestión reúne las aptitudes para el cargo. “Doy fe de su compromiso con los derechos humanos, la defensa de la Constitución y el Estado de Derrecho, como así también la dedicación puesta al servicio de la administración de justicia durante toda su trayectoria”, indicó.
Luego de resaltar su trayectoria de más de 30 años en el Poder Judicial, Knoblovits subrayó que Lijo cuenta con “una sólida formación académica y actividad docente en el ámbito universitario”.
Asimismo, resaltó que “ha demostrado en todos los ámbitos un desempeño destacado, compromiso y seriedad, a los que se suman sus cualidades personales y morales”.
De esta forma, la DAIA se mostró a favor de la iniciativa del presidente Javier Milei, quien propuso a Lijo junto al académico Manuel García Mansilla para integrar Corte, que a fin de año tendrá una nueva vacante ya que el actual ministro Juan Carlos Maqueda cumplirá 75 años, edad límite establecida por la Constitución Nacional. La otra vacante tiene que ver con la salida de Elena Highton de Nolasco, quien por los mismos motivos pasó a retiro. La opinión de Abuelas de Plaza de Mayo
Por su parte, la histórica institución defensora de los derechos humanos, la Asociación de Abuelas de Plaza de Mayo, emitió juicio sobre la nominación de Lijo, en otra misiva dirigida al ministro Cúneo Libarona, que lleva la firma de su presidenta, Estela de Carlotto.
Allí hace un repaso del desempeño de Lijo haciendo notar que ya cuenta con “una opinión fundada en la jurisprudencia de la Corte” y lo insta a que la exprese en caso de ocupar el cargo.
“Esta asociación considera que resulta fundamental que los candidatos tengan una postura clara frente al proceso de Memoria, Verdad y Justicia y los estándares en la materia que han sido receptados en diversos antecedentes de la Corte Suprema de Justicia”, reza la misiva refrendada por la histórica referente de Abuelas de Plaza de Mayo.
El pueblo mira como en aquella época como sacrifican inocentes y se quedan con los corruptos antes que con aquellos que los libraron de los demonios izquierdistas.

La cultura de la corrupción en Argentina hace parte de su historia política-social, constituye el ADN en la sociedad y de las instituciones públicas, ella está generalizada, nadie puede ignorar los “arreglos” en todas las esferas del Estado y particularmente en los estrados judiciales; siempre es bueno tener un juez amigo. Desde hace décadas, jamás un alto funcionario o miembro del poder judicial, legislativo o ejecutivo hizo públicamente conocer esos delitos, con nombres, apellidos, hechos.
Recientemente ese pacto del silencio se rompió porque el Ministro de Justicia de la Nación denunció la comisión de grave delitos en los casos de las indemnizaciones a supuestas víctimas del gobierno militar 76-83.
El 23abril2024, en la entrevista con el diario La Nación, el Ministro de Justicia, precisó entre otros puntos que: “… se procesó a un conjunto de personas por los delitos de asociación ilícita, falsificación de documentos públicos y privados, uso de documentos públicos, falso testimonio, falsa denuncia, estafa y defraudación en perjuicio de la Administración Pública Nacional. A su vez, existen otras causas penales en trámite por irregularidades surgidas por pagos duplicados o realizados a personas que carecen de documentación que respalde su pedido”. Asimismo, el Ministro Cuneo Libarona afirmó que “no podrían haber ocurrido sin una ayuda política”. “No se pueden haber dado estos hechos si no existiera alguna actuación de un funcionario público. Era un festival de pagos, de crear estructuras para generar plata del Estado”,
Los hechos denunciados se conocen como “Fraudes Millonarios con los Derechos Humanos”[2] y la gravedad de esos ilícitos es qué se utilizó a las ONG con la bandera de los llamados derechos humanos, para que, con la complicidad de abogados, altos funcionarios del Estado, miembros de la justicia (jueces, fiscales, secretarios), militantes de DDHH y reales delincuentes, recurriendo a medios ilícitos, tanto en Argentina como en el exterior puedan obtener ilegalmente indemnizaciones faraónicas, como supuestas víctimas del gobierno militar 76-83. Así estafar al Estado argentino y hacer condenar a numerosos inocentes.
Es decir que, se creó una organización criminal internacional para cometer delitos en más de un país, actuando a nivel transnacional con roles y objetivos precisos. Los miembros de esa empresa del delito diseñaron y ejecutaron un plan macabro, formando personas, para inventar hechos, falsificar documentos, crear ex-nihilo una historia, construir pruebas falsas, designar un culpable entre los ex agentes del Estado de los 70’ y hacerlo condenar por crímenes aberrantes, con el objetivo de recibir beneficios millonarios por parte del Estado. ¿Entre cuantos se repartían ese botín? Ese accionar no solo es un delito que tiene sus ramificaciones fuera de las fronteras nacionales, sino también una estafa a la Nación y a sus contribuyentes que aportan a los recursos del Estado para pagar esas indemnizaciones. «La Justicia investiga la existencia de una supuesta asociación ilícita para el armado de documentación falsa para aquellos que simulaban ser hijos de desaparecidos o víctimas de la última dictadura militar» (TN 29abril24).
La justicia honesta con la cooperación internacional debe, inmediatamente, identificar en Argentina y en el extranjero, no solo los que percibieron ilegalmente las indemnizaciones del Estado porque en absoluto fueron víctimas de la violencia por parte del gobierno militar en ese periodo, sino y, sobre todo, porque “sus declaraciones o sus casos”, que sirven de pruebas en los juicios llamados de lesa humanidad, determinaron que numerosas personas fueran imputadas y condenadas a largos años de prisión, cuando en realidad no cometieron delito alguno.
Ese contexto se pudo materializar porque previamente los miembros designados de la organización criminal, tanto en Argentina como en el extranjero (Europa, América Latina), creaban falsos documentos, falsas denuncias, falsas pruebas, falsos testigos, falsas víctimas, con el objetivo de culpar una persona de un hecho inexistente, se lo llevaba a juicio y se lo condenaba por lesa humanidad pese a ser inocente. Ese dispositivo es un proyecto criminal protegido por un círculo perfecto de impunidad, integrado por la justicia en todos sus niveles, abogados querellantes, organizaciones de DDHH, altos funcionarios del Estado, responsables políticos de la Secretaria de Derechos Humanos de la Nación, los que actuaban desde el extranjero y el silencio cómplice de los medios de comunicación. Los procesos judiciales en los cuales estos delincuentes obtuvieron resoluciones favorables no pudieron realizarse sin la complicidad de los magistrados, secretarios, fiscales, secretaria de derechos humanos, asociaciones de derechos humanos, militantes de DDHH, consejeros y asesores nacionales o internacionales.
Por cada persona que cobró una indemnización como integrante de una organización criminal, supone una acción transversal y una incidencia directa en los juicios de lesa humanidad con consecuencias inimaginables, inconmensurable sobre las personas condenadas por delitos inexistentes. Ese impacto no es solamente en la libertad personal, sino en la salud, en la sanción social, la repercusión mediática, el impacto negativo a nivel nacional e internacional, todo ello extensiva a su familia, cuando en realidad nunca existió víctima, ni hecho doloso, ni culpable, todo se limita a beneficios materiales estafando al estado.
Los métodos, las formas y los actores que llevaron y llevan a cabo los delitos denunciados por las autoridades nacionales encuadran perfectamente en la Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional[3], la que precisa, por ejemplo:
Es decir que, esas características por las formas de cometerse el delito de estafa al Estado argentino con los derechos humanos, están comprendidos en la Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional, porque fueron cometidos por un grupo delictivo organizado y estructurado (art.2.a, c), son infracciones graves (art.2.b), esos hechos criminales ocurrieron en más de un país (art.3.2.a, b, c, d), hubo participación a un grupo criminal organizado (art.5), se produjo el blanqueo producto del delito (art.6), para ejecutar esos delitos se cometieron actos de corrupción pasiva y activa (art.8) y sobretodo existió una obstrucción al buen funcionamiento de la justicia (art. 23). Ese descriptivo propio de una empresa del crimen organizada va más allá de la simple asociación ilícita (art 210 CP), o el atentar contra el orden económico de la Nación, (303 CP).
De manera urgente el Gobierno del Presidente Milei, en nombre del Estado de Derecho, de los principios de legalidad, del Orden Jurídico nacional e internacional, de los principios convencionales, constitucionales y de los derechos humanos para todos los individuos que residan en el territorio argentino, debe ordenar:
La sociedad, el contribuyente, el ciudadano honesto, los hombres y mujeres de buena voluntad, necesitan conocer los nombres de los responsables del fraude a la Nación con los Derechos Humanos, que los mismos sean juzgados y condenados. Buenos Aires

La Delegación a Asociaciones Israelitas Argentinas (DAIA) y Abuelas de Plaza de Mayo dieron a conocer este martes su posición respecto de la candidatura de Ariel Lijo para integrar la Corte Suprema de Justicia de la Nación.
Lo hicieron a través de dos cartas, dirigidas al ministro de Justicia de la Nación, Mariano Cúneo Libarona, en la que manifestaron las razones del acompañamiento a la postulación que realizó el presidente Javier Milei.
En el caso de DAIA, su titular, Jorge Knoblovits, indicó que el candidato en cuestión reúne las aptitudes para el cargo. “Doy fe de su compromiso con los derechos humanos, la defensa de la Constitución y el Estado de Derrecho, como así también la dedicación puesta al servicio de la administración de justicia durante toda su trayectoria”, indicó.
Luego de resaltar su trayectoria de más de 30 años en el Poder Judicial, Knoblovits subrayó que Lijo cuenta con “una sólida formación académica y actividad docente en el ámbito universitario”.
Asimismo, resaltó que “ha demostrado en todos los ámbitos un desempeño destacado, compromiso y seriedad, a los que se suman sus cualidades personales y morales”.
De esta forma, la DAIA se mostró a favor de la iniciativa del presidente Javier Milei, quien propuso a Lijo junto al académico Manuel García Mansilla para integrar Corte, que a fin de año tendrá una nueva vacante ya que el actual ministro Juan Carlos Maqueda cumplirá 75 años, edad límite establecida por la Constitución Nacional. La otra vacante tiene que ver con la salida de Elena Highton de Nolasco, quien por los mismos motivos pasó a retiro.
La opinión de Abuelas de Plaza de Mayo
Por su parte, la histórica institución defensora de los derechos humanos, la Asociación de Abuelas de Plaza de Mayo, emitió juicio sobre la nominación de Lijo, en otra misiva dirigida al ministro Cúneo Libarona, que lleva la firma de su presidenta, Estela de Carlotto.
Allí hace un repaso del desempeño de Lijo haciendo notar que ya cuenta con “una opinión fundada en la jurisprudencia de la Corte” y lo insta a que la exprese en caso de ocupar el cargo.
“Esta asociación considera que resulta fundamental que los candidatos tengan una postura clara frente al proceso de Memoria, Verdad y Justicia y los estándares en la materia que han sido receptados en diversos antecedentes de la Corte Suprema de Justicia”, reza la misiva refrendada por la histórica referente de Abuelas de Plaza de Mayo.
