No fue ninguna sorpresa que a Cristina se le otorgara el cumplimiento de la condena en modalidad domiciliaria. Como se dice vulgarmente, se veía venir.
¿EL FALLO ES AJUSTADO A DERECHO?, POR SUPUESTO.
Cristina ya supera la edad de 70 años, uno de los requisitos para acceder a la prisión domiciliaria; además que por una estricta cuestión de seguridad de su persona -debido al intento de homicidio que sufriera- se debe evitar que sufra cualquier tipo de violencia intrapenitenciaria.
NO LO QUE NO ES AJUSTADO A DERECHO ES LO QUE SUCEDE CON LOS DETENIDOS “DE LESA”.
El solo hecho de cumplir 70 años no es requisito para los detenidos de lesa, pues adicionalmente se le exige “graves” dolencias de salud, y decimos “graves” pues para los jueces los achaques que sufre cualquier persona de 70 años o más, no resultan suficiente; como tampoco lo es las cuestiones de seguridad que buscan evitar situaciones de violencia intrapenitenciaria.
Sobre el primer supuesto, sobran los ejemplos de adultos mayores que padecen de serias patologías de salud, sin embargo, los jueces los envían a una cárcel aduciendo que allí pueden tratar sus dolencias. Emblemático son, el caso de NAST, quien a pesar de presentar una seria patología neurológica y contar con un dictamen favorable de la médica forense de Rosario, el Tribunal Oral Federal Nº 2 de esa ciudad decidió revocarle la detención domiciliaria o el caso de AMELONG, que según informe del Cuerpo Médico Forense de la Nación tiene sin funcionar el 30% del ventrículo izquierdo de corazón, lo que lo convierte en paciente con alto riesgo de muerte con necesidad de tener asistencia médica inmediata, a pesar de ello la Sala IV de Cesación entendió que puede estar en una cárcel.
Sobre las cuestiones de seguridad, es grosero el caso del -ya harto conocido- cabo FLORES, quien en su actual unidad de detención (U.16 de Salta) está encerrado 23 horas por día, 6 días a la semana en una celda de reducidas dimensiones utilizadas como de castigo, pudiendo salir solo una hora diaria, excepto los viernes; debido a que ya ha sufrido agresiones por parte de presos “comunes” por solo ser “de lesa”, en otra unidad penitenciaria también de Salta. Ello no es relevante ni para el Tribunal Oral Federal Nro. 5 de San Martin ni para la Sala I de la Casación, que consideran procedente la detención en esas condiciones.
Tampoco es relevante para los diferentes Tribunales Orales, las humillantes condiciones de detención en la cárcel de Bower (Córdoba) donde los detenidos de “lesa” deben compartir pabellón con los ex jefes del Servicio Penitenciario cordobés (encerrados por casos de corrupción), siendo sometidos a continuos vejámenes para “encubrir” la “cómoda” detención que gozan los ex jerarcas penitenciarios.
Nuestra CSJN en el antecedente “Alispeiti” con claridad dispuso: “Que si bien es cierto que la gravedad y atrocidad de los crímenes constituye un factor de ponderación al momento de establecerla cuantía de la pena-dentro del rango normativo estipulado por la escala sancionatoria correspondiente-,y que la calificación legal es uno de los aspectos a tener en cuenta para decidir sobre la procedencia de la exención de prisión y la excarcelación, estos elementos –conforme a las reglas generales que regulan la materia- no intervienen al momento de ordenar la modalidad domiciliaria de ejecución de la prisión preventiva y/o de la pena privativa de libertad”.
ES DECIR, LA GRAVEDAD DEL DELITO SOLO SIRVE PARA MENSURAR LA PENA A APLICAR. A MAYOR INJUSTO MAYOR PENA. AHORA, ESA GRAVEDAD NO JUEGA A LA HORA DE LA EJECUCION O MODALIDAD DE LA CONDENA, JUSTAMENTE PORQUE YA SE CONDENO A LA PERSONA.
Irónicamente, este fallo que se emite en una causa “de lesa” fue utilizado por la defensa de Cristina para justificar el pedido de detención domiciliaria. Y está muy bien que así sea, pues acredita que la Justicia es para todos por igual, no pudiéndose hacerse distingo o categorización antojadizas de delitos. Justamente los kirchneristas reclaman las mismas condiciones de detención que los “de lesa” para su líder, mientras que los “de lesa” reclaman el mismo trato que a Cristina. Ello acredita que LA JUSTICIA DEBE SER IGUAL PARA TODOS. HAY QUE DEFENDER LOS DERECHOS DE CADA CIUDADANO SIN IMPORTAR LA CREENCIA, IDEOLOGIA O PENSAMIENTO. NO SE PUEDE TENER UNA ATICTUD MILITANTE ANTE LA JUSTICIA, conforme reza el art. 16 de nuestra Constitución Nacional.
Al respecto, es patético los malabares dialecticos que hacen los periodistas emblemáticos del canal de noticias “+” -convertido en una grosera propaladora libertaria- al hablar de la domiciliaria de Cristina y tratar de evitar hablar de la domiciliaria de los de “lesa”. Son más funcionales a las “orgas” de los DDHH que sus archienemigos del canal de noticias “5”: que ahora han trasmutado sus vengativos conceptos en respetuosos términos de las domiciliarias de los “genocidas”. Ni hablar del inefable togado de la Casación Federal, ex socio del “Zafa”, que se desvivió, en un reportaje televisivo, por defender los derechos de Cristina mientras condenaba a los “genocidas”, cuando ambos están en igualdad de condiciones legales.
Por último, nos parece más que acertadas las voces que se alzan contra la aplicación de la pena accesoria de inhabilitación absoluta y que piden una reforma del Código Penal, pues ello convierte a los condenados en verdaderos muertos civiles, despojándolos de derechos que nada tienen que ver con el motivo de la condena, como ser la quita de los haberes jubilatorios o derechos electorales. Tales consideraciones, obvio que también se aplican a los “de lesa”.
En fin, un país que se precie de serio debe respetar las garantías constitucionales y procesales para todos los ciudadanos, sin excepción alguna. El irrestricto sometimiento a un verdadero Estado de Derecho así lo impone. El art. 8 de la Ley 24660 (Ejecución de la condena) establece que la ejecución de la pena privativa de la libertad debe realizarse sin discriminación alguna por raza, sexo, idioma, religión, ideología, condición social o cualquier otra circunstancia, prohibiendo además los tratos crueles, inhumanos o degradantes.
No podemos discutir si el balcón si o balcón no, si un adulto mayor puede salir a dar una vuelta a la manzana por su salud, o quien entra o sale de un domicilio. El Estado debe proporcionar al condenado las condiciones necesarias para un desarrollo personal adecuado, que favorezca su integración a la vida social al momento de recobrar la libertad, sin discriminación alguna entre los mismos.
Por ello diremos CRISTINA TIENE RAZON EN SUS RECLAMOS; LOS DE “LESA” TAMBIEN.
