Una jueza se negó en Perú a dar curso a la sentencia de la Corte Suprema que aprobó la aplicación de la eutanasia a Ana Estrada, una psicóloga de 45 años que desde los 12 padece una enfermedad degenerativa e incurable, informó este martes el portal periodístico judicial La Ley.
La decisión emitida por el máximo tribunal peruano en julio del año pasado había sido remitida al Décimo Primer Juzgado Constitucional de la Corte Superior de Justicia de Lima, para ser ejecutada. Sin embargo, Silvia Núñez Riva, la actual encargada de ese juzgado de primera instancia, ha decidido no acatar la orden, alegando que va en contra de sus preceptos morales, y se “abstuvo por decoro”.
“No me es posible ejecutar la misma pues considero, como parte de mi esencia, que el derecho a la vida, reconocido en el artículo 2 de la Constitución es un derecho irrenunciable, creencia que se apoya en mi libertad de conciencia, por lo que, en este caso en particular tengo motivos que no me permiten asumir la ejecución de la sentencia”, aseguró Núñez Riva en una resolución del 23 de enero.
Según explican desde La Ley, con esa postura podría estar incurriendo la letrada en el delito de desobediencia a la autoridad, ya que el caso de Estrada había sido resuelto en la Corte Suprema. En ese contexto, su rol como jueza consiste únicamente en tramitar la ejecución de una sentencia con carácter de “cosa juzgada”. Inhibirse por motivos personales significa que está incumpliendo con sus deberes, algo merecedor de una sanción administrativa, detalla el sitio especializado.
Núñez Riva instó en su resolución a que el caso fuera redistribuido con “urgencia” a través de la mesa de partes de los juzgados constitucionales. Al respecto, la Defensoría del Pueblo de Perú confirmó este miércoles que el expediente de Ana Estrada “hoy ya se encuentra en el Séptimo Juzgado Constitucional, a cargo de la jueza Malbina Saldaña”.
Aunque ya este escenario podría dar pie a que finalmente se proceda con la elaboración del protocolo o procedimiento técnico para aplicarle la eutanasia, la Defensoría del Pueblo solicita “ejecutar con celeridad y urgencia la sentencia”. El organismo recuerda que ya han pasado más de seis meses desde que la Corte Suprema reconoció el derecho de Estrada a morir dignamente y emitió la decisión final. “Ya son casi cinco meses desde que el expediente llegó al despacho del juez de ejecución y aún no se ordena cumplir con lo resuelto”, recalcó.
La Defensoría subraya que el deber del juez encargado es garantizar que la sentencia se cumpla “tal como se resolvió y sin retardar su ejecución”. Asimismo, advierte que nuevas demoras podrían causar “un mayor sufrimiento y padecimiento” a la involucrada.
Ana Estrada sufre de polimiositis, una dolencia sin cura que consume poco a poco los músculos de todo el cuerpo y que la mantiene postrada en una cama la mayor parte del tiempo. Es la primera persona en el país suramericano a la que los jueces han autorizado a poner fin a su vida, después de dictaminar la inaplicación a su caso del artículo 112 del Código Penal, de manera que nadie puede ser perseguido por el delito de homicidio piadoso al practicarle la eutanasia. Su caso es excepcional, ya que en Perú ese procedimiento está prohibido y es penado con tres años de cárcel.

My opinion is based in experience. My aunt had severe arthritis, her fingers, toes were deformed so much so that she couldn’t hold a spoon properly. Also had a bad case of psoriasis where her skin would just die and fall off. Then, when I was perhaps 9 or 10, she had a fall and had to have her ball socket joint replaced. Couldn’t walk. Was then restricted to the house. She had so much trouble doing the simplest of things. Going to the toilet was such a challenge for her. She continued to suffer for over 13 years after her fall, was bedridden for the last few years of her life and died alone in her bed. The day she died; our family was out at my mom’s retirement function. I regret not being able to say goodbye to her. Thinking back, I would have allowed her to get euthanasia. She suffered a lot.
I’m Canadian and I can verify that the option of suicide is given to patients for soooo many things it’s unbelievable. I know of two cases. My friend had a very curable cancer. The doctors said she couldn’t get her treatments without having the u-know-what-jab. She got the u-know-what-jab and two days later phoned the ambulance. Turns out she was one of the first victims of micro clots all over her body. Instantly, her doctor offered her MAiD. He told her she wouldn’t live long and she would be in extreme pain with micro clots in various organs like her bowels and that surgery would be a waste of time. She wanted to live, but was coerced into dying. The family wanted the cause of death to be the u-know-what-jab. The doctor went BALLISTIC and threatened them if they ever mentioned that possibility for her death. He said it was impossible. The next person went to Mexico with her husband. They were violently mugged. The husband died of his injuries sometime later. The wife got SEVERE depression. Her doctor has been offering her MAiD. She has decided to go for it. Nothing else is wrong with her. She has put down one dog. She will put down the other dog just before she goes in for her MAiD. When doctors offer you euthanasia, especially when you are mentally ill, it is soul destroying. BigPharma controls doctors and their medical associations, and the doctors are told that they MUST offer MAiD as a therapy option for certain condition OR if their religion forbids them, they MUST refer the patient to another doctor who will provide MAiD. I’m telling you. This is scary crap. And it is really showing you who the psychopath doctors are. They are really getting off on this stuff. Also, in Canada, they still won’t let family members accompany a family member into an appointment or to the hospital if they did not get the u-know-what-jab. This makes it a LOT easier to isolate and coerce the sick patient for MAiD. I am leaving Canada because of this criminal and evil practice.
