Cuando me refiero a los imputados por los bien o mal llamados delitos de lesa humanidad, entre los cuales me encuentro, generalmente digo que los políticos, poder judicial, periodismo, iglesia y miembros de diferentes fuerzas de uniformados, en no pocas ocasiones nos consideran subhumanos, pero en esta oportunidad voy a ser sincero, ya que lo que en realidad quiero decir es que nos consideran unos PELOTUDOS (1). Empleo el termino subhumano para no herir susceptibilidades de otros prisioneros, así que hoy les pido disculpas a todos por mi grosería, producto de la impotencia ante tanta iniquidad. ¿Se dan cuenta que en este territorio llamado Argentina los únicos que sí o sí, al barrer y a como dé lugar vamos presos muriendo en esa condición, somos nosotros? ¿Qué ILEGALMENTE nos detienen por “inferencias”, nos indagan varias semanas después, recién meses más tarde nos decretan la prisión preventiva, nos mantienen 8, 10 y más años en esa condición, y si sobrevivimos nos niegan los arrestos domiciliarios siendo gerontes y casi despojos humanos? Todo esto viene al caso porque además durante el proceso suelen declarar burdos y falsos “testigos-víctimas” que son encubiertos por fiscales y “querellantas” militantes mientras los togados se hacen los ciegos, sordos y mudos. Por supuesto estos dejan de serlo si el testigo fue presentado por nuestros abogados defensores y se equivocó en algún detalle. Así en el marco del juicio “Mega Causa Zona 5” que desde el mes de febrero de 2022 (más de 3 años) se lleva a cabo en la ciudad de Bahía Blanca, el 9 de noviembre de ese mismo año denuncié, asistido por el excelente abogado defensor GONZALO MIÑO, a los “testigos-víctimas” GUILLERMO EDUARDO QUARTUCCI y CARLOS ALBERTO PASCHETTA por falso testimonio. Como broma del destino luego de tratar de excusarse (sostenía que desde este portal lo desprestigiábamos) los mismos quedaron para ser “investigados” por el Dr. ULPIANO MARTINEZ. Este leguleyo que le debe su actual cargo de fiscal al falaz expresidente MAURICIO MACRI (el que iba a terminar con el curro de los DDHH), en noviembre de 2014 como juez subrogante me había mandado a detener por inferencias, meses antes de ser apartado del cargo por mal desempeño. Ahora, pasaron los años y finalmente el 19 de marzo último, luego de una “sagaz investigación” entre otras sesudas consideraciones actuando como defensor de los falsos testigos y no como fiscal dijo: “Sin embargo, a partir de las constancias de autos se observa que los testimonios de Paschetta y Quartucci no afectaron negativamente la tarea jurisdiccional, puesto que estos manifestaron lo que creían en ese momento que era correcto. La manera de valorar sus testimonios será luego una tarea propia de la función jurisdiccional.
Por ello, solicito que se proceda a dictar el sobreseimiento de Quartucci y Paschetta y, en consecuencia, el archivo de las presentes actuaciones por no encuadrar el hecho investigado en una figura legal (art. 336, inc. 3° del C.P.P.N.)” Según ULPIANO MARTINEZ, mas allá de no tomarles declaración, sin certificarlo aseguró que QUARTUCCI había fallecido. Con respecto a PASCHETTA parece no haber visto, las pruebas que presentamos, demostrando que este había declarado, presentado por la misma Fiscalía, el 16 de junio de 2011 en una causa para condenar, al Teniente Coronel WALTER BARTOLOMÉ TEJADA (fallecido en 2022). Y también el 4 de julio de 2022 (11 años después) cambiando circunstancias lo hizo en el juicio al que estoy sometido. Un verdadero testigo-víctima a la carta.
